Wifi Music School, LLC (“Wifi Music” or “we” or “us”) is committed to fair information practices and protecting your privacy. This agreement (the “Privacy Policy”) describes how we collect, use and/or disclose the information you provide when you or your child visit www.wifimusicschool.com (the “Site”) and use the services available on/through the Site (the “Services”) and is fully compliant with the Children’s Online Privacy Protection Act (“COPPA”).BY ACCESSING OR USING THE SITE OR SERVICES OR BY REGISTERING WITH US, YOU SIGNIFY THAT YOU AGREE TO THIS PRIVACY POLICY, INCLUDING THE TERMS OF SERVICE, WHICH IS INCORPORATED HEREIN BY REFERENCE.

IF YOU ARE A PARENT AND YOU CONSENT TO YOUR CHILD'S ACCESS OF THE SITE, USE OF THE SERVICES AND/OR REGISTRATION WITH US, YOU AGREE TO BE BOUND BY THIS PRIVACY POLICY AND THE TERMS OF SERVICE IN RESPECT OF YOUR CHILD’S ACTIVITIES.

In addition, many of the Services operate via the Skype® internet communication platform (“Skype”). In order to participate in or engage with such Services, you must register for a Skype account and download the Skype application. In addition to this Privacy Policy, any and all use of Skype is subject to the Skype policies (accessible at http ://www .skype .com /intl /en -us /legal / and expressly incorporated herein).

1. THE PRIVACY POLICY, THE SITE AND THE SERVICES

This Privacy Policy governs how we collect, use and disclose your information (or your child’s information) when you (or your child) access the Site and use the Services. The Privacy Policy is only applicable to our Site and our Services and not to any other website, application, service or material that you may be able to access via the Site or Services (whether through an advertisement, content link or otherwise), each of which may have data collection, storage, use and disclosure practices and policies that differ materially from this Privacy Policy.

While you may use some of the functionality of the Site without registering as a Wifi Music member (a “Member”), the majority of the Services require registration. If you access the Site without registering, the only information we collect will be non-personal, aggregate information (collectively, “Non-Personal Information”). A PARENT OR LEGAL GUARDIAN MUST COMPLETE THE REGISTRATION PROCESS FOR ANY CHILD UNDER THE AGE OF 13. To create a Wifi Music account, you are required to provide certain information personally identifying you (and/or your child) (collectively, “Personal Information”). You are responsible for ensuring the accuracy of all Personal Information you submit to Wifi Music, whether on your own behalf or on behalf of your child. Inaccurate information will affect the quality of your experience with the Services and our ability to contact you as described in this Privacy Policy.

2. NON-PERSONAL INFORMATION

Even if you do not register as a Member, we collect and use your Non-Personal Information as follows.

A. Cookies

We use “cookies” to customize your experience with our Services and to store your Members’ usernames and passwords so they do not need to re-enter them each time they visit the Site. Cookies are small computer files that are transferred to your computer hard drive and which contain information such as the pages you visited and the activities you engaged in while using the Site and Services. We do not link the information stored in cookies to Personal Information. You may block or delete cookies from your hard drive; however, by disabling cookies, you may not be able to access all of the features of the Site or use all of the Services. Some of our business partners also use cookies to provide us with anonymous data and information regarding your engagement with our Services. We do not have access or control over these cookies and our Privacy Policy does not cover the use of third party cookies.

B. Web Beacons

We also use “web beacons” to collect anonymous information about the use of our Site and Services and the websites and services of selected sponsors and advertisers, as well as the use of emails, special promotions and/or newsletters we may send you. Web beacons are tiny graphic image files embedded in a web page or email that provide a presence on the web page or email and send back to its home server information from your browser. The information collected by web beacons allows us to statistically monitor how many people are using our Services, visiting selected sponsors' and advertisers' websites, opening our emails, and for what purposes. Our web beacons are not used to track activity outside of our Site. We do not link Non-Personal Information from web beacons to Personal Information.

C. Traffic Data

We automatically track and collect the following categories of Non-Personal Information when you visit our Site: (1) IP addresses; (2) domain servers; (3) types of computers accessing the Site; (4) types of web browsers used to access the Site; (5) referring source which may have sent you to the Site; and (6) other information associated with the interaction of your browser and the Site (collectively, “Traffic Data”). We use Traffic Data to display content that we think you might be interested in, according to your preferences and in emails and other communications we may send you. We do not link Non-Personal Information from Traffic Data to Personal Information.

3. PERSONAL INFORMATION

A. Registration

In order to access certain areas of the Site and use certain Services, we require you to register as a Wifi Music Member and provide us with certain Personal Information. Personal Information includes contact data such as your email address, phone number, username and password. We may use Personal Information to provide you with the specific Services you select, to respond to your questions, to email you about Site maintenance and Service updates and for internal marketing research purposes. Wifi Music does not share, sell, rent or trade your Personal Information with third parties for their promotional purposes.

A PARENT OR GUARDIAN MUST COMPLETE THE REGISTRATION PROCESS FOR ANY CHILD UNDER THE AGE OF 13. To create an account for a child under the age of 13, the parent or guardian must: (a) provide information, including Personal Information about himself/herself and his/her child, which may include data such as your first and last name, email address, Skype username and your child’s first and last name, birth date, username and your child’s musical interests; (b) agree to abide by our Terms of Service and to ensure that any and all use of our Services by the child complies with the Terms of Service; (c) review and consent to our collection and use of your child’s Personal Information as specified in this Privacy Policy. We do not require our minor Members to disclose more information than is reasonably necessary to interact with the Site and to participate in the Services.

B. Emails

We may use Personal Information to send you information about the Site and Services and to contact you in conjunction with certain Services.

C. Updating Personal Information

You may update your Personal Information at any time by logging into your account and clicking on the “My Account” link.

D. Parental Review of Child’s Personal Information

The parent or legal guardian of any Wifi Music Member under the age of 13 may contact Wifi Music at any time and request to review the child's Personal Information, ask to have it deleted and/or refuse to allow Wifi Music to collect or use any of the child's Personal Information in the future. To request any of the above, please send an email to: staff@wifimusicschool.com (with “Parental Account Review” in the subject line of the message), and include the following in your message:

your child’s first and last name, username and password;
your first and last name, your telephone number and email address;
a statement detailing your exact request (i.e. whether you would simply like to review your child’s Account or if you would like it deactivated);
a statement certifying that you are the parent or guardian of the child whose information you are requesting; and
your digital signature.

We will respond to all such requests within 2-3 business days.

4. CALIFORNIA RESIDENTS

California Civil Code Section 1798.83 permits residents of the State of California to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. 5. INFORMATION COLLECTED BY THIRD PARTIES

Certain content and Services offered on/through or in connection with our Site may be served on websites or via platforms hosted or operated by a company other than Wifi Music (“Third Party Contractors”). We will not disclose your Personal Information to a Third Party Contractor without first obtaining your consent; in order to use certain Services, however, you will be asked and required to consent to collection and use policies of a Third Party Contractor. For example, many of our Services require you to register for a Skype account and download the Skype application. Your use of Skype in connection with our Services is subject to the data collection and use policies of Skype in addition to this Privacy Policy. Wifi Music does not endorse and is not responsible for the privacy practices of Skype or any other Third Party Contractor, and you should review the privacy policies of all Third Party Contractors whose Sites you visit or whose Services you use in connection with our Services or otherwise.

6. LINKS

The Site may contain links to third party websites with which Wifi Music has no affiliation. Wifi Music does not share your Personal Information with those websites and is not responsible for their privacy practices. Some websites may have the look and feel of our Site. Please be aware that you may be on a different website and that this Privacy Policy only covers our Site and Services. Should you decide to visit one of these third party websites, we suggest that you read its privacy policy carefully.

7. DISCLOSURE OF INFORMATION

We share the information we collect from you with third parties in the following ways. We share Personal Information with our business partners who assist us by performing core services (such as Site hosting, payment processing, data storage and security) related to our operation of the Site and/or by making certain Services available to our users. Those business partners shall be bound to uphold the same standards of security and confidentiality that we have promised to you in this Privacy Policy, and they will only use your Personal Information to carry out their specific business obligations and to provide you with Site-related Services. Wifi Music does not share, sell, rent or trade the Personal Information of its users with any third parties for their promotional purposes.

We may transfer your Personal and Non-Personal Information to another company in connection with a merger, sale or acquisition by or of Wifi Music. In this event, we will use reasonable efforts to notify you before your information is transferred and becomes subject to a different privacy policy. We also reserve the right to disclose your Personal and Non-Personal Information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process.

If you agree to our collection and use of your child's Personal Information but object to our disclosing the Information to any third party under any circumstance, you may notify us of such preference by emailing us at: staff@wifimusicschool.com or via phone at 347.746.1805. We will honor all such requests; however, please note that instructing us not to share your child’s Information with any third parties whatsoever may limit your child’s ability to use certain Services.

8. MEMBER CONTENT

As part of the Services, Members may have the opportunity to communicate, display, and transmit content featuring their likenesses, voices, appearances, and/or performances (hereinafter, “Member Content”). You are prohibited from disclosing the Personal Information of any child under 13 (including your own Personal Information if you are under 13) in/through Member Content. If you or your child violates this restriction and discloses any Personal Information through Member Content, you should be aware that such Personal Information could be collected and used by third parties, and we shall have no responsibility or liability whatsoever in connection with any disclosures in violation of this Privacy Policy or the Terms of Service.

9. SECURITY

The Personal Information we collect is stored on a secure, password-protected server and only authorized personnel have access to your Information. We use industry-standard encryption technologies with respect to the receipt and transfer of Personal Information you submit. Nevertheless, despite our best efforts, no transmission over the Internet and no data storage method can be guaranteed to be safe 100% of the time.

10. TRANSFER AND STORAGE OF DATA

The Site is hosted on servers in the United States. Accordingly, if you are located outside of the United States, the Personal Information you provide to us will be transferred to the United States. By submitting your Personal Information, you consent to its transfer and storage in the United States and its use in accordance with the purposes for which it was originally collected.

11. CHANGES TO THIS PRIVACY POLICY

We reserve the right, at any time, to add to, change, update, or modify this Privacy Policy so please review it frequently. If we do, then we will notify you here, as well as by posting a notice on our Site and/or by e-mailing you. In all cases, use of information we collect is subject to the Privacy Policy in effect at the time such information is collected.
